Transactions involving persons under the age of 18 years and legal capacity.

The law states that a minor cannot enter into contracts. By accepting these terms and conditions, the customer acknowledges that they are over the age of eighteen (18) years and that they are of sound mind, they are not an undischarged bankrupt and they are otherwise legally entitled to contract with browndog productions. Should browndog productions suffer any damage, consequential or other losses as a result of a transaction entered into by a minor, browndog productions reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed with browndog productions.

Disclaimer
Whilst browndog productions employs the latest in security technology software for its transactions with our customers, browndog productions does not take responsibility for damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner. Furthermore, browndog productions shall not be responsible for any damage or consequential losses (whether direct or indirect) associated with damage to goods occurring during delivery. The customer irrevocably agrees to make a claim upon the transit insurer. By accepting these terms and conditions, the customer acknowledges that s/he has sufficient notice of this disclaimer, s/he has entered into this transaction and accepted this disclaimer of his or her own free will.

Fraudulent Use of Credit Cards
At browndog productions, our primary goal is to ensure our many valued customers are assured that transacting with us is a secure, safe and easy procedure. We take online fraud very seriously and we take every conceivable step to minimise the risk of transacting with a person or persons who wish to fraudulently use credit cards. Therefore, if we have evidence to suspect that a transaction is being or will be conducted by the fraudulent or unauthorised use of a credit card, we will not enter into the transaction. If we have evidence of fraudulent or unauthorised use of a credit card during the course of a transaction or prior to delivery of our goods, we will take all reasonable steps to suspend and cancel the transaction and/or prevent the delivery of goods which are the subject of a suspected illegal transaction. We will also take all reasonable steps to notify the police services on the relevant jurisdiction and assist the police by providing all information pertaining to the transaction to facilitate a prosecution of the offender.

Intellectual Property

browndog productions reserves all rights to all intellectual property owned by it. None of the logos, designs, trademarks and other intellectual property vested in browndog productions and appearing on our website, receipts and literature shall be used by any other individual, corporation, group for any reason whatsoever unless browndog productions gives its express written authority to do so.

Changes to Terms and Conditions

Each order is governed by the terms and conditions current at the time the order is placed. browndog productions may alter, add to or delete from these terms and conditions without notice. You are advised to read and understand these terms and conditions each time you place an order.

Orders
All orders placed through this web site are subject to confirmation by browndog productions. Where the goods are either no longer available, or not currently available, you will be notified by browndog productions as soon as possible.

You may cancel the order by giving notice to browndog productions prior to postage.

Delivery
Australia wide delivery time: 2 weeks.
International delivery time: 3 weeks.
A signature will be required on delivery.

Lost in transit products cannot be replaced until an investigation has been completed with Australia Post, to confirm the item was lost in transit.

Please note: Deliveries are made to the address provided by you when ordering, rather than to a specific individual. Therefore you should only use an address that is secure and where all persons are known to you. If there is nobody at the address to accept the delivery a notification card will be left informing you to pick up the goods from your local Post Office.

Upon individual request in certain areas we can arrange Express Post (guaranteed next day) or same day courier (Brisbane metropolitan area only) delivery. Please contact our sales team on 07 3369 0676 to arrange one of these options. Additional charges apply.

Once the goods are delivered to you, or an authorised representative, you will own them and it is your responsibility if they become lost or damaged.

Complaints must be made within 7 days of delivery to the browndog productions office, either by telephone, email or fax.

Payment
Our web site provides secure payment options using all major credit cards. You can also choose to provide your credit card details over the phone.

We can accept Money Order or Cheque via mail.

Returns & Refunds
Goods purchased from browndog productions can be returned within fourteen 14 days of purchase:
If found to be faulty for exchange or repair at the manufacturers discretion.

For exchange providing goods are returned in their original unopened packaging. Proof of Purchase is required with any return.

For any return you will need to obtain a return authorisation from our company. Please do not return any items without our Return Authorisation Number. We do not accept responsibility for items returned without our Return Authorisation.

No refunds are offered in the replacement warranty period, unless browndog productions is unable to replace the stock.

No refunds are offered if you have changed your mind about the product or made an incorrect choice. Shipping costs are non refundable. Refunds will be issued by cheque.

Once your transaction is finalised, both the electronic and hard-copy information is securely archived. After a period of 7 years both the electronic and hard-copy information is destroyed.

Liability
Any liability of browndog productions in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of browndog productions be limited to:
i. In relation to goods, the replacement of the goods or the supply of equivalent goods; and
ii. In relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

Applicable Law
All purchases under this web site and these terms and conditions are subject to the laws of Queensland, Australia.
